Malta Freeport Terminals Limited has launched the tender for Medium Voltage Facilities & Cables for Terminal 2 Quay Cranes.
The scope of this Tender is split into the following Lots:
LOT 1
Medium Voltage Containerised Distribution Centre and Substation.
LOT 2
(A) Supply, install, joint and terminate 240mm2 XLPE MV cable to extend existing circuit supplying 2E0 DC via 2C0 DC.
(B) Supply, install, joint and terminate 240mm2 XLPE MV cable from the MFC Distribution Centre up to 2E0 DC.
(C) Supply, install and terminate 35mm2 XLPE MV cable from 2E0 DC and from 2E9 DC to their respective crane connection container.
LOT 3
Supply four (4) internally reinforced containers, called ‘Crane Connection Containers’ to each house 4 Medium Voltage connection boxes (latter supplied by Company). Cable entry to these containers will be from a floor opening the size of the cable pit below it.
The Company reserves the right to award individual or multiple contracts for any or all the works listed in this specification.

Site Visit
A technical clarification meeting and site visit for Tenderers shall be offered during Week 29. Tenderers shall be asked to register for the site visit by providing their full name, ID card number, and name of Company they represent, and the contact details of the nominated person present during the meeting. Only two (2) persons will be allowed to participate for each prospective Contractor. Registrations are to be made to the following email address:

Tenderers are advised, in their interest, to inspect the site of works, to ascertain for themselves the conditions of the site itself including the requirements of MFTL operations. The successful tenderer shall be deemed to have inspected and familiarised itself with the site where the works will be executed/services will be provided. In submitting their bid, the tenderers confirmation that they have checked the site and all the conditions that are likely to affect the progress of the works/supply of services shall be implied.
No claims including for extra payment or extension of time (amongst others) arising from lack of knowledge of the site and the conditions thereof shall be entertained. For the avoidance of doubt, tenderers shall have no valid grounds to claim compensation/extension of time because of adverse site conditions which could have been noted or which could have been brought to light following the exercise of any right available to them including that of carrying out a site inspection or to take samples amongst others.
Clarifications
The Tenderer shall promptly notify the Company of any ambiguity upon examination of the Tender Documents. Tenderers requiring clarification or interpretations of the Tender Documents shall make a written request to the Purchasing Department prior to the deadline set in the Tender schedule.
MFTL’s representative reserves the right to keep minutes of such clarification meetings, which minutes shall be made available to all Tenderers through the clarification process.
Save as otherwise is provided in this document including its annexes and any document herein referred to (including but not limited to the General Conditions), any interpretation, correction or change of the Tender Documents will be made by Addendum.
Submission of Tender Offers
All Tenders and any other documents required to be submitted through a soft copy addressed to the Purchasing Manager Ms. Denise Falzon:

For any other documentation / brochures etc. that cannot be sent in soft copy email can be delivered at the front desk at the Malta Freeport Terminals Administration Building reception addressed to the Purchasing Manager.
All offers must be received by not later than the closing date and time indicated in the Tendering Schedule.
The conditions of this Tender and the Contract will not exonerate the Contractor from obtaining and keeping in place throughout the whole duration of the Contract any licences, permits, authorisations, approvals, or no objections required from any competent authority. If such are revoked or withdrawn by the competent authorities, the Contract will be terminated as MFTL may in its sole discretion deem fit. MFTL may also opt to obtain such permit, license, authorisation, or approval on the Contractor’s behalf, at the Contractor’s cost.
MFTL reserves the right to conduct inspections from time to time to ensure that the terms and conditions of the Tender and the Contract are being complied with;
Any breach of any of the terms and conditions of the Tender or the Contract may lead to the termination of the Contract by MFTL, without prejudice to any other legal action that may be taken in terms of the Contractor, Tender documents or at law.
In the event of termination of the Contract, or if MFTL enforces any of the rights competent to it, MFTL shall not be held responsible for any damages or loss sustained by the Contractor, including claims for loss of business or recovery of the expenses made.
Tenderer’s Price Offer
Tenderers are requested to submit a price in accordance with the pricing schedule. The Price submitted shall include all costs to be incurred by the Contractor in completing the Works, as well as the cost of all items to be used or supplied in conjunction with the Works.
These costs shall include, but not limited to, design, manufacture, project management, all charges for packaging, packing and delivery, profit, overheads, establishment, insurance, all facilities required, all relevant taxes, costs associated with the warranty period, labour costs, cost for all plant and equipment, cost of all material listed on the drawings which are required to fully complete the Works as outlined in the Scope of Work.
Prices shall only be submitted in Euro currency
Project Schedule
The project is to be completed with a handover to MFTL for operations in the shortest time possible. Project schedule shall be contractually binding to ensure a swift handover and completion of project with minimised operational down time. The Tenderers are to provide a delivery schedule for each lot that they shall be tendering for. In the event of award, contractors will then be expected to coordinate with MFT Project Manager to ensure smooth transitions and avoid schedule conflicts.
All site works are to be covered by a risk assessment and method statements.
All Contract works shall be undertaken in accordance with the:
- Maltese Government’s electrical and safety regulations and standards including but not limited to the latest version of The Network Code – Approved by the Malta Resources Authority – Issued by: Enemalta Corporation
- European IEC Standards
- Conform to the latest IEE Wiring Regulations.
- All the electrical equipment complies with relevant product standards.
Contractor’s Warranties
In addition to the requirements of the relevant Standards, the Contractor warrants to the Company that:
The Contractor has the skills, qualifications and experience necessary to, design where required, install, commission and test and complete the work under the Contract as required by the Company; and can offer example of previous works of a similar nature for inspection if deemed necessary.
The Contractor will, in the performance of the work under the Contract, comply with all relevant Regulatory Requirements and with the lawful requirements of local and other relevant authorities insofar as they affect or are applicable to the work under the Contract.
The Contractor will install, commission and test the equipment so that when commissioned at the Terminal will:
i. Meet proper standards of workmanship and be in accordance with the requirements of the Contract, all relevant Regulations and Standards, the requirements of the electrical regulator, electrical supply company Enemalta, and be free of defects and omissions.
ii. Not infringe any patent, registered design, copyright or other intellectual property rights.
iii. Be fit for the intended purpose in all respects and will be capable of being operated at their designed capacity.
iv. Comply with all the requirements of the Contract, including, but not limited to, the requirements of the Specification and the Drawings.
The Contractor has carried out a site visit and fully understood the requirements.
The electrical equipment and systems when commissioned will be capable of being operated in conformity with the requirements of all authorities having jurisdiction over the equipment.
The warranty shall cover the complete delivered products (include all electrical components such as MV CBs, transformers, isolators, MCCBs, RCDs etc and the containerised rooms themselves) and requires that the Contractor provide all parts and labour at his own expense to properly rectify any defect found in the system up to the expiration of the warranty period.
During the warranty period, MFTL shall in all cases first advice the Contractor of the defect and give the Contractor the first opportunity to attend to it. Another Contractor will be engaged only when the Contractor fails to rectify the matter expeditiously, or in a satisfactory manner, and the reasonable costs thereof will be to the Contractor’s account. If the Company deems the defect critical to the operation of the system, the defect will be attended to within four (4) hours, otherwise the defect must be attended to within forty-eight (48) hours from the time the defect is reported to the Contractor.
Such work by another Contractor shall not relieve the Contractor of his obligations under the Contract.
The Contractor is to inform the Company of any Safe Operating Procedures (SOPs) or bulletins issued by the original equipment manufacturer regarding any of the equipment used in this project. Should the Contractor wind down his company then the Contractor is to ensure that MFTL continues to receive such SOPs/bulletins.
During the warranty period, an emergency breakdown service shall provide a guaranteed maximum four (4) hour response to callout outside normal hours, and a guaranteed maximum one (1) hour response to callout during normal hours. Any breakdown repair work which, in the opinion of the Malta Freeport Terminals Limited has been caused by negligence on the part of the Contractor shall be rectified at no additional cost.
Contractor is liable for any work that is subcontracted to other contractors.
The Contractor shall ensure that all manufacturers and subcontractors’ warranties required under the Contract and all customary warranties from manufacturers and Contractors who carry out work or supplied plant or equipment in relation to the electrical equipment are provided to the Company. The provisions of such warranties shall not in any way modify or limit any of the rights, powers or remedies of the Company against the Contractor in contract, tort or otherwise. The warranty for all components/devices used in this project will be extended to 5 years after first failure and will be considered as a latent defect for the others used in this project.
